2. Agreement to the Terms
By using the Site and/or the UPS Services, you acknowledge that you have read, understood, and agreed to these ToU. Your continued use of the Software and Service indicates your acceptance of any modifications we may make to these ToU. We will notify you of any essential modifications and ask for your implied consent. Therefore, it is important to regularly review these ToU for any updates.
To ensure clarity throughout these ToU, the following terms shall have the meanings ascribed to them:
- Ultimate Phone Spy Software: A mobile application and/or a computer program designed to provide monitoring functionalities. It consists of server and client parts, where the server part is accessed through the web interface on the Site, and the client part is installed on a target device with the Android operating system. For iOS target devices, no application installation is required, and data collection and execution of features are facilitated through the server part using the target device’s iCloud login and password in the Control Panel.
- Subscription: The periodic payments made for using the Software and/or accessing the Services on a recurring basis.
- Target device: Refers to a smartphone, tablet, mobile phone, or similar device on which the client part of the Software is installed (in the case of Android) or connected to through the Control Panel (in the case of iOS).
- Payment information: Includes the user’s full name, email, credit/debit card data, and any other information required for payment processing.
- Payment service provider: A financial institution that processes payments for UPS Services, with which UPS has a payment processing agreement.
- Lawful access to a target device: Denotes the user’s access to a target device owned by them, as well as the existence of other legal grounds for collecting and processing information from the target device.
- Cloud control: The management and control of an account, application, and program facilitated through cloud technologies, without requiring physical intervention on the target device or software installation.
- UPS Assistance: A type of service provided by UPS’s specialists to assist users with remote installation, rooting, and jailbreaking of target devices.
- Subscription month: A paid subscription period consisting of 28 calendar days. This applies only to 1-, 3-, and 6-month subscription plans. The 12-month subscription lasts for one calendar year (366 days).
4. General Provisions
The Site and UPS Services are intended to be used only in the following cases:
- Parental control: The Software is primarily designed to ensure the security of children and wards, protecting their property, life, and health.
- Users on their own devices: The Software and Services may be used by individuals on their own devices for monitoring purposes.
To purchase and use the UPS Service, you are required to create an account on the Site, providing personal information such as your email address, billing information, and payment method. Upon account registration, we will only receive your ID and email details. After registering an account and purchasing the UPS Service, you will receive a URL link to download the .apk file in your Control Panel.
To synchronize a target device with your account, you need to click the provided link, download and install the .apk file on the target device, and grant the necessary permissions to activate the declared features. For iOS target devices, synchronization with the Control Panel requires specifying the iCloud login and password.
When providing payment information during the purchase of the Software, you acknowledge that UPS does not collect this information. The Payment Provider is responsible for receiving and processing payment details. While we strive to maintain the security of your data, we are not liable for any third-party data leaks in databases or DSN servers.
By using the Site or UPS Service, you agree to comply with all applicable laws. It is important to note that we are not responsible for the manner in which you use the UPS Software beyond providing the initial access and services.
Before placing an order on the Website, you consent to reading the Compatibility Policy and checking the requirements of your target device according to the Compatibility Policy. Physical access to the device is usually required to install the UPS Software. It is your responsibility to follow all provided instructions and documentation accurately.
To maintain the security and integrity of your account, you should not allow any third party to access your account or utilize the Software without your consent. We are not liable for any unauthorized access granted deliberately or unintentionally.
We reserve the right to modify, terminate, or refuse the UPS Services to anyone, at any time, and for any reason without prior notice. We also reserve the right to alter these ToU as necessary.
5. Rooting and Jailbreaking
Certain features of the Software may require rooting (for Android) or jailbreaking (for iOS) of the target device. You understand and agree that rooting or jailbreaking a target device is solely your responsibility. You are aware of the potential consequences and assume all associated risks and liabilities.
In the event that you purchased a subscription that provides features requiring root or jailbreak, but decides not to root or jailbreak the target device after payment, this does not create grounds for a refund or change your subscription type. However, you may upgrade to another subscription type after the expiration of your current subscription period, which does not require the aforementioned features.
Please note that the UPS Software does not perform the rooting or jailbreaking procedures itself. You must use third-party software to perform these actions. We are not responsible for the third-party software you choose to use or any consequences resulting from their use.
To subscribe to the Service, you need to place an order on the Site. Various subscription plans are available, depending on your device, the number of features you desire, and the subscription period. You are allowed to have multiple subscriptions under the same account, with one subscription per target device unless you have purchased a subscription that permits simultaneous usage on multiple devices.
During the ordering process, you will be required to provide your personal information, complete the billing details, and select the payment method. Following the purchase of the Software, your login credentials (username and password) will be sent to your email, granting you access to your Account/Control Panel.
We strongly recommend downloading and securely storing your private encryption key from the Control Panel or saving it to your email for password reset and account access recovery purposes. Please note that we do not store or retain user private keys, and we are unable to assist with access recovery without the private key.
Subscription plans are available for durations of 1, 3, 6, or 12 months. A 12-month subscription consists of 366 calendar days. Depending on your subscription plan, you may use the client part of the Software on multiple target devices, but you must reinstall it from the current device to the new one unless your subscription permits simultaneous usage on several devices.
To ensure continuity of service, the selected subscription will be automatically extended for the same duration and at the original, non-discounted price. During the subscription payment process, you may have the option to purchase additional services, the price and conditions of which depend on the chosen services.
Please note that we are not liable for any consequences resulting from the services rendered. If harm occurs to the target device due to the services provided, we will not be held responsible.
Subscription renewal occurs automatically unless you turn off auto-renewal at least 24 hours before the end of the current subscription plan. In the event that the Software is temporarily unavailable for technical reasons, we reserve the right to charge you for the next subscription period if you did not disable automatic renewal.
Canceling automatic renewal can be done through the Control Panel or with the assistance of our support team via Live Chat or email. If you forget to disable auto-renewal for a new subscription period, it does not qualify for a refund. By not disabling auto-renewal, you will be charged for the subsequent subscription period.
To unsubscribe from the Service, you need to contact our support team. You may not use another user’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for all activities that occur under your account and must keep your password secure. If you suspect any unauthorized use or compromise of your account, you must notify us immediately.
